1. Introduction

These Terms and Conditions ("Terms") govern the use of the website operated by SCRG Ltd and the provision of construction and related services by SCRG Ltd ("we", "us", "our").

SCRG Ltd is a company registered in England and Wales under Company Number 17059822, with its registered office at 9 Whimberry Way, Withington, Manchester, England, M20 4SG.

By accessing our website or engaging our services, you agree to be bound by these Terms. Please read them carefully before proceeding.

2. Services

SCRG Ltd provides construction, refurbishment, project management and related services ("Services") as agreed with each client on a project-by-project basis. The specific scope of works, timescales, costs and any special conditions will be set out in a separate written quotation or contract issued to the client prior to commencement of any works.

Nothing on our website constitutes an offer to provide Services. All enquiries are subject to a formal quotation and signed agreement before any obligation arises on the part of SCRG Ltd.

3. Quotations and Pricing

All quotations provided by SCRG Ltd are valid for 30 days from the date of issue unless otherwise stated in writing. Quotations are based on information provided by the client at the time of enquiry. Any change in scope, specification or site conditions may result in a revised quotation.

Prices quoted are exclusive of VAT (where applicable) unless expressly stated otherwise.

4. Payment Terms

Payment terms will be specified in the relevant project contract or quotation. Unless otherwise agreed in writing:

  • A deposit may be required prior to commencement of works.
  • Interim payments may be required at agreed stages throughout the project.
  • Final payment is due upon practical completion of the works.

We reserve the right to suspend or terminate works where payment is not received in accordance with the agreed terms. Overdue invoices may attract interest in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

5. Client Responsibilities

To enable us to carry out the works effectively, the client agrees to:

  • Provide accurate and complete information regarding the site and project requirements.
  • Ensure we have appropriate access to the site at agreed times.
  • Obtain any planning permissions, building regulations approvals or other consents required prior to commencement, unless otherwise agreed in writing.
  • Ensure the site is safe and free from hazards not related to our works.
  • Promptly notify us of any issues or concerns that arise during the project.

6. Variations

Any variation to the agreed scope of works must be authorised in writing by both parties before being carried out. Verbal instructions will not be binding on SCRG Ltd. Variations may affect the contract price and programme.

7. Defects and Remediation

We will remedy any defects in our works that arise within 12 months of practical completion, provided that such defects result from faulty workmanship or materials supplied by SCRG Ltd. This does not affect any statutory rights you may have.

Defects arising from fair wear and tear, misuse, failure to maintain, or works carried out by third parties are excluded from this obligation.

8. Limitation of Liability

To the fullest extent permitted by law, SCRG Ltd shall not be liable for any indirect, special or consequential losses, including loss of profit, loss of business, loss of revenue or loss of data arising out of or in connection with our services.

Our total liability to you in respect of any claim shall not exceed the total value of the contract sum paid or payable by you to us.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

9. Insurance

SCRG Ltd maintains appropriate public liability insurance. Details of our insurance cover are available on request.

10. Health and Safety

SCRG Ltd is committed to complying with all applicable health and safety legislation, including the Construction (Design and Management) Regulations 2015 (CDM 2015). We will maintain and adhere to appropriate health and safety plans for each project.

Clients are responsible for ensuring that their own staff and any other persons on or near the site comply with all relevant health and safety requirements.

11. Intellectual Property

All designs, drawings, plans and documentation prepared by SCRG Ltd remain our intellectual property unless expressly agreed otherwise in writing. You may use such documents solely for the purpose of the project for which they were prepared.

12. Confidentiality

Both parties agree to keep confidential any sensitive commercial information shared during the course of their engagement and not to disclose such information to any third party without prior written consent, except where required by law.

13. Termination

Either party may terminate the contract by giving written notice if the other party commits a material breach of these Terms that is not remedied within 14 days of written notice requiring it to do so, or if the other party becomes insolvent.

In the event of termination, SCRG Ltd shall be entitled to payment for all works completed and materials purchased up to the date of termination.

14. Governing Law

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. The parties agree to submit to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to These Terms

We reserve the right to update these Terms at any time. Any changes will be posted on this page with a revised "last updated" date. Your continued use of our website following any changes constitutes acceptance of the updated Terms.
